All bookings carried out by this website are subject to the following terms and conditions.

If you wish to book a PRIVATE HIRE VEHICLE via this website, https://pumpkincars.co.uk/, you must agree to the terms below as the exclusive basis which governs such booking and must tick the “I agree to Terms & Conditions” box on the booking form. If you do not agree to any of the terms, do not book a PRIVATE HIRE VEHICLE via this website. If you are booking on behalf of someone else, by clicking “I agree to Terms & Conditions”, you are representing that you have their authority to accept these terms and conditions on their behalf.

Definitions

  • “US/WE”: This website and its appointed agents, drivers who carry out the bookings.
  • “You”: The person who enters details.
  • “Passenger”: Any passenger carried in a Minicab which is booked via this website.
  • “Quote”: A fixed price quote that you receive via the website for the trip.
  • “This Website”: The pumpkincars.co.uk website and its social pages displayed elsewhere in any form on any device.
  • “Agreed Pick-Up Point”: The appointed place for you to be picked up by us.
  • “Agreed Time”: The appointed date and time for you to be picked up by us.
  • “Personal Data”: The details which you provide regarding your physical and email addresses, telephone number, and card details.
  • “Booking”: The booking of a Minicab effected via this website for undertaking trips. Bookings can be made for single trips, return trips, or split trips.
  • “Card”: The credit, debit, or charge card, or PayPal account you use when making the booking.
  • “Cash”: The payment you make for the fare to this website and/or its driver.
  • “Card Costs”: The charges due to the credit card companies or PayPal used by you to pay for the trip.
  • “Details”: The details which you must provide upon making a booking, including pick-up date and time, pick-up and drop-off addresses, and your personal data.
  • “Fare”: The fee paid by you for the quote you accept.
  • “Goods”: Any goods carried in a Minicab which are booked via this website.
  • “Trip”: The journey you wish to make from the pick-up address to the drop-off address provided by you.
  • “Particular Requirements”: Any specific requirements you may have relating to disabled facilities, the gender of the driver, or otherwise.
  • “Minicab”: A Private Hire Vehicle made available for pre-booked trips, in compliance with the requirements of relevant licensing authorities.

Bookings and Payments

  1. It is your responsibility to ensure that your booking details are correct.
  2. When you make a booking, this constitutes an offer by us which we may or may not accept.
  3. Your booking is only deemed confirmed after receiving a notification from us via email/SMS/phone call stating that your booking has been confirmed.
  4. We reserve the right to cancel any booking before it takes place. If we cancel any booking, all monies received will be returned in full.
  5. We reserve the right to correct typographical errors in any information that appears on the website, including pricing mistakes. If you are informed of such an error, you may withdraw your offer and will receive a full refund.
  6. We can collect all monies owed to us in advance for card bookings, while drivers will collect money for cash bookings.
  7. We reserve the right to ask for full or part payment in advance for cash bookings, especially for long-distance journeys.
  8. Once you have confirmed your booking on the payment screen, it cannot be canceled or changed except in accordance with our cancellation terms and conditions.
  9. Refused card payments will result in the cancellation of the booking.
  10. Payment will not cover any extra requirements you request, such as child seats. Additional fees may apply.

Insurance

We strongly advise all passengers to take out appropriate insurance cover to cover your journey as neither we nor the drivers shall be responsible for any injury or loss that you may suffer while using our services.

Cancellations and Refunds

  1. If you wish to cancel your booking, you must notify us as soon as possible.
  2. Cancellations made more than 24 hours before the scheduled pickup time will be fully refunded.
  3. Cancellations made less than 24 hours before the scheduled pickup time may incur a cancellation fee.
  4. No refund will be given for cancellations made after the driver has been dispatched.

Cancellation & Refunds

  1. You can cancel a booking made through our website.
  2. You must inform us via our website by filling out the contact form or by calling us, and by providing us with the booking reference number.
  3. Cancellation clauses could be triggered as per the cancellation cut-off time informed to you in the booking confirmation email. If you paid by card, you will receive a full refund less card costs. If cancellation is after the cut-off time specified in the booking email and these terms and conditions, no monies will be returned. If you paid by cash, your profile will be marked, and you may not be able to make further bookings through our website unless you pay the cancellation charges.
  4. In the event that the driver does not turn up at the agreed pick-up time within 30 minutes of the agreed time (or within 60 minutes if the pick-up point is an airport), you have the right to cancel the booking and receive a full fare refund, without any card costs deducted (only if you paid in advance by card), as full and final settlement of any claim you might have in respect of such failure. However, you can continue with the trip at your own discretion, and if you do, no refunds will be made.
  5. If you fail to be present at the agreed pick-up point within 15 minutes or fail to make contact with the driver or the office within 15 minutes (or 30 minutes if the pick-up point is at an airport), the driver has the right to assume your booking is canceled and leave. In this case, you will not be entitled to a refund of the fare paid.
  6. It can take up to 7 working days to process your refunds.
  7. All refunds will be made only to the card used to make the booking.

Limitation of Liability

  1. All our drivers and vehicles are licensed by the relevant authorities. In some cases, we may use third parties to carry out bookings made with us, but we will only use licensed drivers and vehicles for this purpose.
  2. We shall not be liable for any delays in pick-up or drop-off or if no driver turns up at the agreed pick-up time.
  3. We shall not be liable in any event that causes direct or indirect loss due to our service or delays, or failure of a driver to turn up at the agreed pick-up location at the agreed time.
  4. Our aggregate liability in respect of these Terms and any matter arising out of it (including claims whether made in contract or tort) shall be limited to £500.
  5. Subject to what is expressly provided in these Terms, all warranties, conditions, or other terms implied by statute or common law are excluded as far as legally possible.
  6. Nothing in this clause shall operate to exclude any rights you may have under consumer legislation or limit our liability for death or personal injury arising out of our negligence.
  7. We will keep you informed via email and SMS messages about your trip but will not be liable for any direct or indirect loss incurred due to any delay in such emails or SMS alerts.
  8. Each foregoing sub-clause of this clause shall constitute a separate and severable provision. The provisions of this clause shall continue in effect notwithstanding the termination, completion, or any other matter which might otherwise cause these Terms to become ineffective.

Cancellation Fee

  1. Booking can be cancelled for a full refund less any card fees up to two hours before the agreed pick-up time. No refund will be made in any other circumstances.
  2. If a driver has been dispatched and it takes more than two hours to arrive at the agreed pick-up location, the value of the realistic time spent on that journey, calculated at £25.00 per hour pro rata, will be deducted from the fare, along with any card fees. The remaining amount will be refunded.
  3. If the booking is made within less than two hours of the agreed pick-up time, the full amount less card fees and any driver dispatch time (if the driver has been dispatched) will be refunded.
  4. All our drivers are dispatched from Heathrow. In calculating the value of time in clause 2 above, travel time from Heathrow will be used as a reference.

About Journey

  1. We can provide a baby/booster or infant seat for a charge of £5.00 extra each if requested at the time of booking. We cannot guarantee that such seats will be available or a good fit for the child traveling.
  2. The passenger must specify the child’s age in the comment section of the booking form. Our saloon and estate cars can only carry a single child seat. If you need a second child seat, you must book an MPV or larger vehicle.
  3. Passengers are strongly advised to allow enough time for their journey, especially when traveling to the airport. We will not be held responsible for delays due to traffic or any other reason.
  4. All pickups from airports and cruise ports are allowed 30 minutes free from the landing time/docking time or booked time. After this period, waiting time will be charged at £20.00 per hour pro rata. Flight delays are exempt from this charge.
  5. Where possible, we will monitor flights only for late arrivals.
  6. Pickups from home, hotel, offices, and other venues are allowed 10 minutes from the actual booked time. After this period, 25p per minute (minimum £3.00) will be added to the fare quoted, payable to the driver in attendance.
  7. Any missed flights must be reported to the office by calling us or by email as soon as possible so that we can notify the driver not to enter the airport for that pickup. If the journey was prepaid, it will be refunded after deducting card fees for bank charges. However, if the passenger wishes to take a later flight, we will provide the service at no extra cost.
  8. If the wrong date and time were provided by the booker, the clause about cancellation fees will govern that booking.
  9. It is the passenger’s responsibility to ensure that they order the correct type of vehicle to carry the number of passengers and luggage.
  10. We reserve the right to refuse any passenger our services due to excess luggage, which would make the vehicle unsafe on the road.
  11. Passengers are responsible for loading and unloading their belongings, and we will not accept liability for loss or damage to the luggage.
  12. We do not accept any responsibility for missed flights for any reason, including traffic delays, accidents, breakdowns, severe weather conditions, or any unforeseen circumstances.
  13. For any alterations to the booking, you must inform us by email or phone call.
  14. All cash bookings must be reconfirmed at least 24 hours prior to the pickup time if the booking window is more than 24 hours.
  15. For cash bookings, we reserve the right to request a deposit or the full amount before a car is dispatched or the booking is carried out.
  16. No car will be sent out for online cash bookings if we have not received reconfirmation, if the booking contains incorrect information, or if the passenger cannot be contacted or reached at the phone number provided at least 6 hours before the pickup time.
  17. We reserve the right to adjust prices on the following dates: from 18:00 hours on December 24th to 23:59 hours on December 26th, and from 18:00 hours on December 31st to 23:59 hours on January 1st, which will be charged at 50% higher than normal prices.
  18. The customer is liable for any toll charges payable, as all our prices advertised are exclusive of toll charges.

Privacy Policy

  1. We will maintain the confidentiality of personal data collected as part of making a booking. This data will not be shared with third parties without your consent. We may amend this Privacy Policy and will make such changes public via the website.

Miscellaneous

  1. The above terms form the agreement between the parties.
  2. All notices to us shall be given by you in writing to info@pumpkincars.co.uk.
  3. All notices to you shall be given in writing to the email address you provided at the time of booking. All notices may be served by email and shall be deemed to have been given 1 hour after transmission thereof.
  4. These terms and your agreement with us shall be governed and construed in accordance with English Law. You irrevocably agree, for the exclusive benefit of pumpkincars.co.uk, to submit any dispute hereunder to the jurisdiction of the courts of England. However, nothing herein shall prevent us from taking proceedings against you in any other court of competent jurisdiction.

Privacy Policy

Your personal data is processed in accordance with our Privacy Policy, which you can view on our website. By using our services, you agree to the collection, use, and transfer of your information as set out in the Privacy Policy.

Limitation of Liability

We are not liable for any loss or damage you may suffer as a result of any failure or delay in the performance of our obligations which is due to any cause beyond our reasonable control.

In any event, our liability to you will not exceed the total cost of the fare.

Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to Terms

We reserve the right to amend these terms and conditions at any time without prior notice. Any such changes will be posted on this website and will become effective immediately upon posting.
